Terms of Service

1. Agreement

By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to both you and the organization.

2. The Service

MCP-LINK provides:

• An edge-hosted gateway that routes Model Context Protocol (MCP) messages between AI agents;
• An agent registry and discovery API;
• Artifact storage with time-limited or authenticated download links;
• A downloadable self-hosted gateway for local and private-network use;
• Related documentation, dashboards, and tooling.

The Service is provided as a platform. We provide infrastructure, while you remain responsible for the agents, prompts, tools, and content you connect through it.

3. Accounts & eligibility

• You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.
• You must provide accurate registration information and keep it updated.
• You are responsible for safeguarding your account credentials and API keys. All activity under your keys is attributed to you.
• Notify us immediately at [email protected] if you suspect unauthorized access.

4. Acceptable use

You agree not to use the Service to:

• Violate any applicable law or regulation, or infringe the rights of others, including privacy and intellectual property rights.
• Transmit malware, or attempt to gain unauthorized access to any system.
• Attack, disrupt, or overload the Service or any third-party system, including denial-of-service or attempts to circumvent rate limits.
• Transmit content that is unlawful, harmful, harassing, or facilitates fraud.
• Send data you do not have the legal right to transmit, including personal data processed without a valid legal basis.
• Reverse-engineer, scrape, or resell the Service without written permission.
• Build systems whose primary purpose is generating unlawful or deceptive automated content at scale.

We may suspend or terminate accounts that violate these rules, immediately and without prior notice where necessary to protect the Service or other users.

5. API & rate limits

• Access to the API is granted via scoped tokens. You may create keys only for your own use.
• Rate limits apply per plan. Sustained abuse or attempts to circumvent limits may result in throttling or suspension.
• We may version, deprecate, or change API endpoints. Breaking changes will be announced by email or on the product changelog with at least 30 days notice where practicable.
• You must handle error responses and respect retry semantics documented in our API reference.

6. User content

• Ownership. You retain all rights to the MCP messages, artifacts, and files you transmit or store as User Content. We claim no ownership.
• Limited license. You grant us a non-exclusive, worldwide license to process, store, transmit, and display User Content solely to operate and improve the Service for you.
• Responsibility. You represent that you have all necessary rights and legal bases to transmit your User Content, including any personal data of third parties.
• Deletion. You may delete artifacts at any time. Upon account termination, User Content is deleted within 30 days except where retention is required by law.

7. Licenses & intellectual property

• The Service, including software, gateway binaries, documentation, website content, trademarks, and branding, is owned by us or our licensors and is protected by intellectual property laws.
• We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.
• Where components of the gateway are released as open source, those components are governed by their respective open-source licenses.
• You may not use our name, logo, or branding without prior written permission.

8. Fees & billing

• A free tier is available with documented limits, including request and storage caps.
• Paid plans, if offered, may be billed monthly or annually through the configured payment processor. Prices are exclusive of applicable taxes unless stated otherwise.
• Subscriptions renew automatically unless cancelled before the end of the current billing period.
• Refunds are not guaranteed except where required by law or explicitly stated at checkout.
• We may change pricing with at least 30 days notice. Continued use after the change takes effect constitutes acceptance.

9. Service availability

• We target high availability but do not guarantee uninterrupted service on free tiers.
• Paid plans may include additional service commitments described in separate commercial documentation.
• Maintenance windows will be announced in advance where practicable.

10. Termination

• By you. You may stop using the Service and delete your account at any time.
• By us. We may suspend or terminate access for material breach of these Terms, unlawful activity, non-payment, or to comply with law.
• Effect. Upon termination, your right to use the Service ends. Provisions that by nature survive, including ownership, disclaimers, liability, and governing law, continue to apply.
• Data export. Before termination takes effect, you may export your artifacts and configuration data where those capabilities are available.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

The Service is infrastructure for AI agent communication. We are not responsible for outputs, decisions, or actions of the agents, models, or tools you connect through it. You are responsible for evaluating and controlling the behavior of your agents.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR USD 100.

13. Indemnification

To the extent permitted by law, you agree to defend and indemnify us against third-party claims arising from your use of the Service in violation of these Terms or applicable law, your User Content, or the agents, tools, or applications you connect through the Service.

14. Governing law & disputes

• These Terms are governed by the laws applicable in the jurisdiction where the service operator is established, without regard to conflict-of-law rules.
• Disputes will be resolved by the competent courts of that jurisdiction, except where mandatory consumer protection law provides otherwise.
• The UN Convention on Contracts for the International Sale of Goods does not apply.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced by email or on the product changelog at least 14 days before taking effect. The "Last updated" date above reflects the current version.
